STAMFORD — Benjamin Malloy, the 21-year-old son of Mayor Dannel Malloy, pleaded guilty to attempted first-degree robbery and an older drug possession charge at state Superior Court Wednesday.

In exchange, Malloy, of 277 Ocean Drive E., is to receive a sentence that involves no jail time: a 10-year suspended prison sentence and five years of probation.

“We didn’t give him a slap on the wrist,” said the prosecutor, State’s Attorney David Cohen. “He pleaded guilty to two felonies.”

Since his arrest, Malloy has made steps to enter treatment programs and rehabilitate himself, which the state wants to encourage, Cohen said. The 10-year sentence hanging over Malloy’s head, should he violate probation, is longer than might be the case with such charges, he said.

The maximum prison sentence Malloy could have received to the two charges he admitted to was 27 years. Judge Richard Comerford Jr. warned Malloy that he could be sentenced to the maximum should he commit another crime before his sentencing on Nov. 30 or fail to appear in court that day.

In a statement, the mayor, who plans to run for governor, said his son has struggled with mental health and substance abuse issues for several years.

“While he continues to receive treatment for those illnesses, today in court Ben took responsibility for his actions and is being held accountable,” the statement said. “We love our son, and we are encouraged that Ben continues to make progress in his

treatment and rehabilitation. He remains committed to putting in the hard work it will take to make him well again.”

Malloy’s co-defendants — Michael Krepak, 20, of 571 Roxbury Road, Stamford, and Karl Hanson 17, also of Stamford — each pleaded guilty Sept. 17 to first-degree criminal trespass and conspiracy to possess marijuana, both misdemeanors. In exchange, they received suspended two-year prison sentences and two years of probation.

Police have said Malloy, Krepak and Hanson went to 19-year-old Eric Sing’s home in Darien to buy marijuana March 3. Instead, Malloy pulled out a BB gun, and Hanson brandished a .22-caliber pistol that fires blanks, according to arrest warrant affidavits. When Sing resisted, the trio fled, affidavits said.

Sing originally said three armed and masked men tried to invade his home, police said. He told police that after the men pulled out guns, he got his own .22-caliber rifle. Hanson told his co-defendants they were being shot at as they drove away, and a subsequent search revealed shell casings in the yard, according to affidavits.

Sing, of 165 Kings Highway North, pleaded guilty to possession of marijuana. He received a suspended one-year prison sentence and two years of probation.

In court, Cohen told Comerford that he had to wrestle with the attention the case got as he worked toward what he felt was a fair and just disposition to the case.

“I did not want to be punishing this individual because of who his family is,” Cohen said. “But I didn’t want to give the appearance there was some special (circumstance) because of who his family is.”

Malloy was also arrested in November 2007 on suspicion of selling drugs to a wired informant four times during a two-month investigation, according to a police report. Greenwich police charged him with possession of a controlled substance or less than 4 ounces of marijuana, conspiracy to commit that crime, possession of narcotics, sale of a controlled substance and use of drug paraphernalia.

In June 2008, he entered a two-year program for first-time offenders that would have cleared the drug charges from his record. He also enrolled in a drug rehabilitation program. That program was terminated and Malloy pleaded guilty to a drug possession charge Wednesday.

“We are giving the defendant one last opportunity to try and rehabilitate himself,” Cohen said. “This is one last chance. Either he makes it or a good, substantial portion of his life will be spent in our (prison system.)”

Stamford mayor’s son among four arrested in Darien drug robbery

A Darien man and a son of the Stamford mayor were arrested by Darien police after a drug deal went wrong on Old King’s Highway North. The Darien man originally reported an attempted home invasion Tuesday morning, which police discovered to be untrue.

Stamford Mayor Dan Malloy’s son Ben Malloy, 21, and Eric Sing, 19, of Darien, were arrested Wednesday night, according to news reports.

“We’ve developed some substantial leads in the case,” Darien police Capt. Fred Komm told The Darien Times on Wednesday afternoon. “We are applying for arrest warrants for those responsible. We expect to make arrests in the case in the next few days.”

It didn’t take the police that long.
The arrest warrants were issued Wednesday evening. Malloy later turned himself into Darien police. He was charged with first-degree robbery and conspiracy to commit first-degree robbery. He was released on a $2,500 bond with a March 18 court date.

Police searched Malloy’s Stamford home Tuesday evening, the Stamford Advocate reported tonight.

Sing of 165 Old Kings Highway North was charged with second-degree falsely reporting an incident, criminal attempt to sell marijuana, possession of marijuana, possession of narcotics and possession of drug paraphernalia.

A drug deal was supposed to happen at 1 a.m. Tuesday at Sing’s home. Three men, according to police, arrived at the Old King’s Highway home, which included Malloy, to buy the drugs.

When the three men knocked on the side door, Sing went outside to make the drug deal, police said. But then two of the men pulled guns on Sing, demanding the drugs without pay. Sing backed away, got inside, closed the door and called police.

Police have not said which two of the men had the guns. According to reports, police have recovered a .22 caliber blank gun.

“He stepped outside to talk to them, they pulled the guns, but he was somehow able to get inside and close the door,” Komm told The Darien Times before the arrests were made.

When Sing called police, he falsely told the dispatcher, and later officers on the scene, that it was an attempted home invasion, police said.

“It was not an attempted home invasion,” Komm said. “It was an expected drug transaction, and they tried to rip off the alleged victim.”

“The alleged victim was selling drugs to the three men,” Komm added. “He lied to police, he falsely reported what happened.”

The three men, described as white males in their early- to mid-twenties, were clad in hooded sweatshirts concealing the bottom of their faces. They left the area in what was described as “an older model vehicle, possibly a Volvo, Oldsmobile or Lincoln,” according to police.

“There will be a total of four arrests,” Komm said. “The three that showed up to make the drug transaction, and the alleged victim is going to be arrested also.”

In addition to the male resident, there were four other people at home that did not witness the encounter because they were on the second floor, police said.

The incident remains under investigation by the Darien Police Department’s Detective Division and anyone with information is asked to call 662-5330.

Two other arrest warrants have been issued, but the names have not been released
